Custody Evaluations
Custody investigations or evaluations are often ordered in contested custody and visitation cases. These evaluations are essential in helping the judge understand what is in the best interest of the children. Custody evaluators meet with each parent. If appropriate, they may meet individually with each child. They also interview neighbors, teachers, physicians and others who may have some insight on the history of the family and the ability of each parent to care for the children. They may also contact references provided by the parents. Evaluators may review educational, medical and mental health records, as well as check for criminal records and other pertinent information. Finally, the evaluator may visit each parent's home and observe their interaction with the children in that context. The evaluator is usually asked by the court to prepare a written report, and may be required to testify at trial. The parties are usually required to pay the cost of the evaluation which can be high. If an evaluation has been ordered and you feel you cannot afford to pay the fee, contact your Family Support Services Coordinator to see if you qualify for a fee waiver. Refer to your county for more information. |
