Under the current Maryland Rule 18-407, all proceedings as to complaints and investigations are confidential and not available to the public. In addition, Investigative Counsel’s work product and records not admitted into evidence in a public hearing before the Commission, the Commission’s deliberations, and records of the Commission’s deliberations are confidential and not available to the public.
The documents that are not confidential, include: (i) after a filing of a response to charges alleging sanctionable conduct, or expiration of the time for filing a response, the charges and all subsequent proceedings before the Commission on them; (ii) unless otherwise ordered by the Supreme Court of Maryland, the record of Commission proceedings filed with the Supreme Court of Maryland; and (iii) the materials posted on the Commission’s website.
