Public Notice - Civil Form Revisions due to Legislation - 10/01/2023

PUBLIC NOTICE - FORMS REVISED DUE TO LEGISLATIVE CHANGES EFFECTIVE 10/01/2023.

HB0102, Ch. 488: Real Property Actions for Possession- Pet Protections 

  • requires the Judiciary to include the Department of Agriculture's link to a fact sheet that provides information about how a person may care for and protect pets in the event of an eviction on any warrant issued under a failure to pay rent, tenant holding over, breach of lease or wrongful detainer actions. 

HB0036, Ch. 481 / SB0100, Ch 482: Actions to Repossess- Proof of Rental Licensure

  • requires a landlord to plead and support with facts that the property is licensed in compliance or exempt from local rental licensing requirements.

HB0127, Ch. 709: District Court - Small Claims - Enforcement of Money Judgments

  • prohibits the District Court in aid of enforcement or execution of a money judgment resulting from a small claim ($5,000 or less), from ordering the appearance of an individual for an examination or to answer interrogatories.
