PUBLIC NOTICE - FORMS REVISED DUE TO LEGISLATIVE CHANGES EFFECTIVE 10/01/2024

SB0019, Ch. 347: Failure to Pay Rent Proceedings - Shielding of Court Records 

  • Requires the District Court to shield court records relating to a failure to pay rent proceeding within the specified timeframes. This is to be applied prospectively and may not be applied to any action initiated prior to October 1, 2024.

HB0693, Ch. 124Renters' Rights and Stabilization Act of 2024

  • Increases the time period for issuing a Warrant of Restitution to seven (7) business days; and, requires an increase to surcharges on certain fees, charges, and costs in certain civil cases.

HB1117, Ch. 125Landlord and Tenant - Failure to Repair Serious and Dangerous Defects - Tenant Remedies (Tenant Safety Act of 2024)

  • Allows a tenant to file a breach of warranty of habitability against the landlord if the landlord fails or refuses to make repairs or correct conditions within a reasonable period of time.
